1.WHO WE ARE

1.1We are PetNet360 (company registration number 406125) whose registered office is at 1 George Square, Castle Brae, Dunfermline, Fife, United Kingdom, KY11 8QF ("we", "us", "PetNet360").

1.2Our website is operated by PetNet360. Our Privacy Policy  and Terms of Use (respectively referred to from now on as the "Privacy Policy" and the "Terms of Use") apply when you register on our website http://www.petnet360.co.uk  ("our Site"). Please read the Privacy Policy and Terms of Use carefully before you register or open an account on our Site. 

2.TERMS OF USE

2.1Access to and use of our Site is provided by PetNet360 on the terms set out below. By accessing and using PetNet360 you agree to be bound by these Terms of Use.

2.2These terms and our Privacy Policy are subject to change from time to time without notice so should be checked regularly. Continued use of this Site will be deemed acceptance of the updated or amended terms.

3.REGISTRATION AND USE OF THE SITE AND ANY SERVICES

3.1In order to participate in and contribute to PetNet360 you are require to register with PetNet360. Any personal information will be collected in accordance with our Privacy Policy.

3.2You agree to use PetNet360 only for lawful purposes, for your own personal or internal business use. You agree not to use PetNet360 in any way which infringes the rights of, restricts or inhibits anyone else's use and enjoyment of PetNet360.

4.INTELLECTUAL PROPERTY RIGHTS

4.1All PetNet360 trade marks, design rights, patents and other intellectual property rights on this Site are vested in PetNet360 or its licensors. Any products, technology or processes and their handbooks or materials may be subject to intellectual property rights owned or licensed by us or third parties. All copyright notices in the original materials must be retained.

4.2PetNet360 is not responsible for any file downloads. Materials downloaded from other users may be subject to restrictions and limitations as may be asserted by them.

4.3This Site may not be modified, disassembled, decompiled or reverse engineered in any way. No part of PetNet360 may be reproduced or stored in any other website without our permission.

4.4Your images, photos and information

4.5You remain the owner of the content and information you share on our Site. By uploading your content you grant us a non-exclusive, royalty-free, irrevocable right and licence to use your content and to sub-license such use to third parties (such as administrators who operate the Site and companies/organisations with whom we have relationships for the provision of syndicated services). You confirm that you have all the necessary rights to grant PetNet360 this licence.

4.6We may use your content for the operation or promotion of our Site (including products on our Site), or for marketing purposes (subject to the Privacy Policy). We may distribute, publish, modify or adapt your content. 

5.COMMUNITY RULES

5.1You agree to use PetNet360 in accordance with the following Community Rules.

5.2Content

5.3You may NOT post:

5.3.1anything that is confidential in nature.

5.3.2any facts that are inaccurate or any opinions that are not genuinely held.

5.3.3anything that could be interpreted as self-publicity.  This includes spamming, posting the same or similar message across many discussions, advertising (including pyramid selling and chain letters), selling or soliciting.

5.3.4anything unlawful or offensive – do not, for example, send or post material that is indecent, racist, defamatory, harassing, threatening, seditious, blasphemous,  fraudulent or contravenes the applicable laws regarding the transmission of technical data exported from the US or the country in which you reside.

5.3.5the personal details of others or misrepresent your identity or affiliation with any person.

5.3.6any third-party material that infringes any legal rights such as copyright or other proprietary rights.

5.3.7anything which is technically harmful including viruses, logic bombs, Trojan horses, corrupted data or other malicious software.

5.4Consent

5.5Before you use an image, including a photograph, or include information about another individual, you must have the consent of the person whose image or information it is and/or the owner of that image to use that image or information and to allow us to store the image or information for use by you on our Site from time to time. In the case of images of children who are not capable of giving consent, you should ensure that the relevant consent is obtained from the child's parent or guardian. By letting our Site use an image or photograph or information, you confirm that you have obtained the necessary consents referred to in the above paragraph. We do not accept any liability whatsoever for any information, image or photograph for which you have used on the Site without the consent of the person, parent or guardian and/or owner (as the case may be). 

5.6Style

5.7Members may not shout at other members by posting in all capital letters.

5.8Please consider your use-of-language for those whose first language is not English.

5.9Always exchange ideas in a civil and measured manner.

5.10Responsibility

5.11You will:-

5.11.1Accept responsibility for all material that you publish on PetNet360.

5.11.2Always acknowledge the name of the source of any third-party material legitimately quoted or referred to.

5.11.3Not quote any member who specifically requests not to be quoted

5.11.4Not intentionally misquote another member or any PetNet360 representative.

5.11.5Not abuse the facility to send an individual member a personal message.

5.11.6Keep your password confidential at all times.

5.11.7Not disrupt the normal flow of conversations within PetNet360 or act in any way to the detriment of other users.

5.11.8Respect the spirit and tone of PetNet360.

6.MONITORING AND COMPLAINTS

6.1PetNet360 is not responsible for monitoring or moderating the services and discussions on PetNet360. We exclude all liability for any loss or damage (whether direct or indirect) arising from the use of our Site or any products or services advertised on it.

6.2Please report any transgressions to PetNet360 at including any misuse of the personal messaging facility. 

6.3Do not misuse the channels for complaint – persistence may result in action by in respect of your account.

6.4PetNet360 reserves the right to review, refuse or delete any contribution which we consider in breach of the Terms of Use, or take action against any user account, at any time, for any reason.

If you believe that any content on the Site is defamatory of you, infringes your copyright or infringes any of your other legal rights please email us the details requested below (completed as appropriate) to INFO@PetNet360.CO.UK

7.BREACH OF TERMS OF USE

7.1If we consider that you have breached any of these Terms of Use we may take such action that we consider appropriate such as:

7.1.1Immediate temporary or permanent withdrawal of your right to participate in PetNet360 or use our Site in any way and/or removal of any of your contributions or material on PetNet360;

7.1.2An issue of a warning and possibly legal action; and

7.1.3Any other action that we deem appropriate.

8.DISCLAIMER

8.1Content

8.2The content posted on PetNet360 is created by members of PetNet360 and used to provide an open discussion forum. PetNet360 is not responsible for any conduct of, or content posted by, PetNet360 members including but not limited to any errors or omissions in any content or any loss or damage caused as a result of any content posted, e-mailed or otherwise available from PetNet360.

8.3Your access to and use of our Site is at your own risk. PetNet360 is provided on an AS-IS basis. PetNet360 makes no warranties, representations or undertakings about:

8.3.1any of the content of this Site (including, without limitation, any as to the quality, accuracy, completeness or fitness for purpose of any such content); or

8.3.2any content of any other website referred to or accessed by hypertext links or otherwise through this Site ('Third Party Site').

8.4PetNet360 does not endorse or approve the content of any Third Party Site, nor will PetNet360 have any liability in connection with any of them (including, but not limited to, liability arising out of any allegation that the content of any Third Party Site infringes any law or the rights of any person or is obscene, defamatory or scandalous).

8.5Functionality, viruses

8.6PetNet360 does not warrant that functions, materials and information available on this Site (and/ or linked to this website) will be uninterrupted or error free, that defects will be corrected, or that this Site or its server are free of viruses or bugs and other items of a destructive nature. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy particular requirements for the accuracy and security of the data input and output.

8.7General

8.8We hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and make no representation or warranty, express or implied, as to the accuracy or completeness or satisfactory quality or fitness for a particular purpose of the information on our Site or any software accessible through our Site. To the extent permitted by law, and subject to Clause 8.10, we hereby expressly exclude liability for:

8.8.1all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;

8.8.2any direct, indirect or consequential loss or damage incurred by you or any user in connection with our Site and/or or any applications or software on our Site or linked to from our Site, or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

(a)loss of income or revenue;

(b)loss of business;

(c)loss of profits or contracts;

(d)loss of anticipated savings;

(e)loss of data;

(f)loss of goodwill;

(g)wasted management or office time; and

(h)for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if reasonably foreseeable, provided that this condition shall not prevent claims for loss of, or damage to, your tangible property.

8.9Our liability under or in relation to our Site in respect of all claims (whether for negligence, breach of contract or otherwise) will be limited to £50. 

8.10The provisions of this Clause 8 do not limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

9.OUR RIGHT TO VARY THESE TERMS AND CONDITIONS OR THE PRIVACY POLICY

9.1We may revise these Terms of Use or the Privacy Policy at any time by updating them on the Site. You are expected to check the home page of the Site from time to time to take notice of any changes we made, as they are binding on you.  Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our Site. 

10.NON-WAIVER

10.1The failure or delay of PetNet360 to exercise or enforce any right in these terms does not waive its right to enforce that right.

11.GOVERNING LAW AND JURISDICTION

11.1The Terms of Use and the Privacy Policy shall be governed by and interpreted in accordance with Scots law and the Scottish courts shall have exclusive jurisdiction over any disputes.

12.PETCARD TERMS AND CONDITIONS OF SALE

12.1 PetCards are sold by PetNet360 Ltd, Penguin House, Castle Riggs, Dunfermline Fife, KY11 8SG

12.2 We will use our reasonable endeavors to reply promptly to all correspondence, please in the first instance e mail customercare@petnet360.co.uk, or call our customer service hotline on 0845 241 0285.

12.3 These terms and condition relate to the purchase of a PetCard.  This PetCard is personalised to your pet including detailed information which you have registered on www.petnet360.co.uk.  As the purchaser of this card it is your responsibility to ensure that all details are correct prior to purchasing the PetCard.  You will be given the opportunity to review your details and the crop of the picture that you have selected before completing the transaction.  Incorrect details including the photo cannot be amended once the order has been placed. 

12.4 By uploading a photo you warrant that you have obtained all of the necessary third party consents to permit you to do so.

12.5 The cost of a PetCard is £12.99 for a single card and £19.99 for two identical cards, both costs include postage and packaging.

12.6 Once you have placed an order for a PetCard through our website the order will not be treated as having been accepted until you receive confirmation from us via e mail that this is the case.

12.7 Offer codes may be published or offered via 3rd parties from time to time.  Offer codes can only be used for PetCard orders via our website.

12.8 Delivery is made via Royal Mail standard post to addresses in the UK only.  Please allow 10 days for delivery from the date of order.

12.9 Complaints or claims must be notified within 28 days of receipt of the product, or in the case of non delivery within a reasonable time after the PetCard was expected to arrive.
